Prostitution, the word's oldest profession, is
still strongly regulated and carries some stiff penalties in Florida.
Undercover police have become more relentless in making arrests for
both offering and solicitation of prostitution.
The penalties vary depending on whether the accused has any prior prostitution
conviction, or whether the person has any sexually transmitted diseases.
The penalties are:
- A second degree misdemeanor for a first prostitution
violation (punishable with up to 60 days in jail)
- A first degree misdemeanor for a second prostitution
violation (punishable with up to a year in jail)
- A first degree misdemeanor if the person has previously tested
positive for a sexually transmitted disease and knew about it.
- A 3rd degree felony for a third or subsequent prostitution violation
(punishable with up to 5 years in jail)
- A 3rd degree felony if the person has previously tested positive
for HIV and knew about it.
Additionally, there are manatory fines, and a person convicted of
a prostitution charge must undergo screening for sexually tranmitted
diseases.
