Under Florida law, a person may be entitled to get a criminal arrest sealed or expunged depending on the disposition and particular charges. If a person’s record is sealed or expunged, that record will not appear on a background check and, except in extremely limited circumstances, the person can lawfully deny that he/she was arrested for a charge that was sealed or expunged.

The law regarding sealing criminal charges continues to change, and the Florida legislature continues to limit what charges may be sealed. In fact, several years ago it was possible to get certain charges sealed that today are prohibited from being sealed.
