Sealing or Expunging in Florida
If you are interested in sealing or expunging a previous criminal arrest in Orlando, Central Florida or anywhere in Florida, then a defense attorney at the Law Firm of NeJame, LaFay, Jancha, Ahmed, Barker, Joshi and Moreno, P.A. will be able to assist you. Not all previous criminal arrests are permitted to be sealed or expunged, however a great many are. As such, we will be able to counsel, advise and if appropriate, seal or expunge your prior criminal record.
Under Florida law, a person may be entitled to get a criminal arrest sealed or expunged depending on the disposition and type of a particular charge. If a person's record is sealed or expunged, that record will not appear on a background check, except in limited circumstances. In fact, in most instances Florida law establishes that the person who has had their case or file sealed or expunged can lawfully and legally deny that he or she was ever even arrested for the charge.
The law regarding sealing criminal charges continues to change, and the Florida legislature continues to limit what charges may be sealed. In fact, several years ago it was possible to get certain charges sealed that today are prohibited from being sealed. As such, there may be a benefit in acting as soon as you are able, if you are considering sealing or expunging your prior criminal record. Moreover, one is only permitted to do this once in their life and they must not have any prior criminal convictions. Accordingly, it is typically best to address this matter sooner than later as future conduct may prevent one getting their record sealed or expunged.
