Florida statute 787.06. Florida’s Human trafficking law went into effect in 2016 and is meant to combat people being forced against their will to perform commercial sex acts (Sex Trafficking) or otherwise being forced to perform labor or perform other services. The Florida legislature stated that Human and Sex Trafficking was a form of modern day slavery and that the victims are subjected to force, fraud, or coercion for the purpose of sexual exploitation or forced labor. All offenses that comprise Human or Sex Trafficking are extremely serious and the penalties upon conviction are severe.

Sex Trafficking Offenses - Penalties

There are several ways someone can commit the offense of Human or Sex Trafficking and are detailed below with their possible penalties.

Anyone who engages or attempts to engage in human or sex trafficking, or benefits financially from human or sex trafficking:

  • For labor or services any any child under the age of 18 commits a felony of the first degree.
  • Using coercion for labor or services of an adult commits a felony of the first degree.
  • Using coercion for commercial sexual activity of an adult commits a felony of the first degree.
  • For labor or services of any child under the age of 18 who is an unauthorized alien commits a felony of the first degree.
  • Using coercion for labor or services of an adult who is an unauthorized alien commits a felony of the first degree.
  • Using coercion for commercial sexual activity of an adult who is an unauthorized alien commits a felony of the first degree.
  • For labor or services who does so by the transfer or transport of any child under the age of 18 from outside this state to within the state commits a felony of the first degree.
  • Using coercion for labor or services who does so by the transfer or transport of an adult from outside this state to within the state commits a felony of the first degree.
  • For commercial sexual activity who does so by the transfer or transport of any child under the age of 18 from outside this state to within the state commits a felony of the first degree.
  • Using coercion for commercial sexual activity who does so by the transfer or transport of an adult from outside this state to within the state commits a felony of the first degree.
  • For commercial sexual activity in which any child under the age of 18, or in which any person who is mentally defective is involved commits a life felony.
  • Any parent, legal guardian, or other person having custody or control of a minor who sells or otherwise transfers custody or control of such minor, or offers to sell or otherwise transfer custody of such minor, with knowledge or in reckless disregard of the fact that, as a consequence of the sale or transfer, the minor will be subject to human trafficking commits a life felony.

If a person causes great bodily harm, permanent disability, or permanent disfigurement to another person during the offense, a first degree felony will be reclassified to a life felony.

First degree crimes are punishable by up to 30 years in prison, 30 years of probation (the combination of incarceration and probation may not exceed 30 years) and a fine of up to $10,000.

Life felonies are punishable by up to a life sentence, life probation, and a fine of up to$15,000.
