Retired Officer Denied Bond In Son's Death - Attorneys Argue Incident Was Self-Defense, Not Murder

ORLANDO, Fla. -- A former police officer accused of killing his own son is now behind bars.

Timothy Davis Sr. was released from the hospital Friday afternoon and taken straight to jail.

During his initial appearance, his attorneys argued he should not be charged with first-degree murder.

Police said Davis, 47, shot and killed his son after an argument at a home on King's Eagle Lane in the Pines of Wekiva subdivision last weekend.

"I did not mean to kill him. I have nothing to hide. I was not trying to kill him. I just lost it," Davis said, according to investigators.

According to an arrest affidavit, Davis said his son punched and pushed him, bloodying his mouth. Police said he told them that he went to his car, got the gun and shot his son twice.

Davis has been hospitalized since the incident and was rolled into the courtroom in a wheelchair Friday afternoon.

He plead not guilty to the charge.

Davis' attorney told the judge that the incident was a matter of self defense.

"Tim Jr. was the aggressor in that attack," attorney Michael LaFay said.

The judge did not agree with the LaFay's assessment, saying the charge stands.

The judge also refused to let Davis out on bond and refused a request to release Davis from jail for a short time on Saturday to view his son's body.
